Please read the following terms & conditions of Polaris Motorcycle Tours Limited carefully before making any booking or payment.
These terms and conditions will form the basis of the agreement between the person making the booking – whether that person is the person taking the tour or not; all persons listed on the booking – if not the person making the booking; and Polaris Motorcycle Tours Limited.
The following terms and conditions clearly outline the rights and obligations of the contract between the person making the booking – whether that person is the person taking the tour or not; all persons listed on the booking – if not the person making the booking; and Polaris Motorcycle Tours Limited.

 

1. Basic Assumptions Between Polaris Motorcycle Tours Limited & The Client

Within these terms and conditions, any references to ‘client’, ‘he/she’, ‘you’, ‘your’, and ‘they’ relates to:

→  The person making the booking – whether the person making the booking is physically taking the tour or not.

→  The lead passenger and all accompanying persons listed on the booking, whether or not they are the person making the booking.

→  All persons on whose behalf a booking is made or any other person to whom a booking is subsequently added or transferred.

Within the terms and conditions, any references to ‘we’, ‘us’, or ‘our’ relates to Polaris Motorcycle Tours Limited.
By making a booking, the person making the booking agrees on behalf of he/she and all other persons detailed on the booking that:

→  That he/she has read these terms & conditions and that all parties by applied inference agree to be bound by them.

→  That he/she consents to the use of personal data processed within the booking in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data are required for implicit safety reasons, such as specifically required information on health conditions, disabilities, dietary or allergy requirements, and insurance details, as per the following terms and conditions.

→  That he/she is over 18 years of age or over when placing an order for services, and that all persons detailed on the booking are 18 years of age or over (Polaris Motorcycle Tours Limited does not provide services to, and neither does it allow accompanied minors on any tour services).

→  That he/she making the original booking fully accepts financial responsibility for full payment of the booking on behalf of all persons detailed in the booking.

→  That he/she also applies implied transfer of financial responsibility to all persons listed on the booking.

 

2. The Contract

→  The contract is between Polaris Motorcycle Tours Limited and the client, the client being any person that directly makes a booking, and including any person who is added or substituted after booking as a lead or accompanying person undertaking a tour. The generic term of this contract between parties will from hereon be described as ‘we’ and between ‘us’.

→  All parties agree by implied consent that English law (and no other) will apply to the contract and to any dispute, claim or other matter of any description, which may arise (except as set out below).

→  We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury), which arises between us, must be dealt with by the Courts of England only, where Polaris Motorcycle Tours Limited is legally registered.

→  No person other than a formal company director of Polaris Motorcycle Tours Limited has authority to vary or omit any of these terms.

→  No promise of a discount or refund will be binding on us unless confirmed by us formally in written correspondence or as a right as documented in the terms and conditions noted below.

 

3. The Securing of Bookings

→  To secure any booking with Polaris Motorcycle Tours Limited, we must provisionally receive payment of the minimum deposit of 20% of the total tour cost for each person as invoiced.

→  If the original booking is placed within 90 days of the start of the tour, full payment of the tour costs is required.

→  For some specific tours, including any bespoke tours that require significant planning and up-front planning and preparation costs, full payment for a service may be required at the time of booking and this will be confirmed in official correspondence during the early discussions of any agreement.

 

4. The Making of Bookings

Any person making a booking with Polaris Motorcycle Tours Limited by telephone, email, or via our website, will be deemed to have agreed to the following conditions:

→  That they have read and accepted our terms and conditions, privacy policy, liability waiver, and the general information pages contained on our website and within any correspondence emails.

→  That any persons making or undertaking tours with Polaris Motorcycle Tours Limited fully understand, appreciate, and accept the inherent risks involved in participating in motorcycle adventure tours, including but not limited to the hazards of travelling in remote regions of developing countries, with medical facilities and response times that are often significantly more limited than those in developed countries, and that by the very nature of the activities that they will be exposed to, there is an implied element of personal risk over and above those associated with conventional organized tours.

→  These risks include the risk of both minor and serious personal injury and damage to personal property, including and up to death.

→  That all participants in any motorcycle tours with Polaris Motorcycle Tours Limited or their associated partners undertake the travel entirely at their own risk, and that Polaris Motorcycle Tours Limited are not liable in any way for any injury – minor or serious, damage to property, or death that occurs during a motorcycle tour, whether a rider, pillion, or other participant.

→  That any participant does not knowingly suffer from any pre-existing medical condition or disability which may prevent them from actively participating in the relevant tour.

→  If any person suffers from any medical condition or disability which may affect their tour arrangements, they must contact and speak with Polaris Motorcycle Tours Limited before making any booking in order that an assessment can be undertaken regarding any participants potential fitness to undertake such a tour. This assessment is not discriminatory, and motorcycle tours conducted by Polaris Motorcycle Tours Limited are inherently not suitable for those with restricted mobility or for those with some medical concerns or conditions.

→  A booking is only accepted and only forms a contract between Polaris Motorcycle Tours Limited and the client when we receive the appropriate booking deposit payment, and a booking confirmation and receipt is issued by us in confirmation.

→  It is important to note that only at this point does Polaris Motorcycle Tours Limited agree to enter a contract and to provide a service, and that we may – at our own discretion and without explanation, refuse to provide a service and that we may refuse to enter a contract by providing this confirmation in correspondence and to reimbursing any payment made within 7 working days of receipt.

→  For booking requests made via our website, any acknowledgement of a booking request that we provisionally send electronically is not a confirmation of the booking or the agreement of a contract.

→  Polaris Motorcycle Tours Limited will primarily communicate to clients regarding bookings in correspondence by email to the email address listed at the time of booking. This email must be checked on a regular basis and the client must respond to emails with critical information as requested and required.

→  We may also contact clients by telephone and/or post if we cannot, for whatever reason, make contact by email, and this will be to the telephone number and address provided at the time of the booking.

→  If the client changes their email address, telephone number, or address, ensuring that Polaris Motorcycle Tours Limited is updated is at the responsibility of the client, and any changes must be emailed to info@polarismotorcycletours.com

→  AnyimportantmessagesorrequirementsthattheclientwishestosendtoPolarisMotorcycleTours Limited, must be sent to info@polarismotorcycletours.com

→  Alternatively, recorded written correspondence should be sent to the following address, clearly stating the senders name, email address, telephone number, address, and booking confirmation number (if applicable), including a full explanation of the reason for the correspondence:

5. Payments & Pricing

The following payment and pricing conditions are agreed by both Polaris Motorcycle Tours Limited and the person making the booking, including the lead person and all accompanying persons, as per the contract of the booking.

→ That the balance of all monies due, including any surcharges applicable at that time, must be received by Polaris Motorcycle Tours Limited no later than 90 days before the start date of the tour.

→  In the case of a failed non-payment of the full balance at 90 days before the start date of the tour (or within a reasonably agreed timeframe), Polaris Motorcycle Tours Limited reserves the right to treat your booking as cancelled and all cancellation charges will apply (see section 7).

→  Payment of both the initial 20% deposit and any full settlement amount can be made by cash (on agreement of amicable transfer conditions), credit/debit card, or by electronic bank transfer into the Polaris Motorcycle Tours Limited business account as detailed on the invoices.

→  Polaris will confirm all monies received by providing confirmation of a receipt.

→  Polaris Motorcycle Tours Limited reserves the right to amend the price of unsold tours at any time and to correct errors in the prices of confirmed tours that may have already been advertised.

→  Polaris Motorcycle Tours Limited reserves the right to advertise tours at a lower price than advertised to and paid for by other clients. The reason for this is to ensure minimum rider numbers and to ensure that tours can go-ahead.

 

6. Amending Bookings

The following tour amendment conditions are agreed by both Polaris Motorcycle Tours Limited and the person making the booking, including the lead person and all accompanying persons, as per the contract of the booking.

→  Any reasonable costs or charges incurred by us or incurred or imposed by any of our suppliers will be charged against the client if a confirmed booking is amended or transferred to a different departure date or tour, up to 60 days prior to the departure date.

→  Thereafter, and within 89 to 1 day prior to the tour start date, all changes will be treated as cancellations and are subject to the charges noted below in section 7.

→  Any requested tour changes are subject to availability, and there is no obligation on Polaris Motorcycle Tours to facilitate any tour change where it is either difficult or impossible.

→  If any lead passenger or any member of a booking is prevented from travelling, that person(s) may transfer their place to someone else, subject to the following conditions:

    • That person is introduced directly by the person cancelling the tour and satisfies all the tour and original booking conditions.
    • That Polaris Motorcycle Tours are formally notified with all required details not less than 14 days before the commencement of the tour.
    • That the person transferring the service remains liable to pay any outstanding balance payments as per the original contract.
    • An administration fee of £100 GBP is required as an essential administration fee to Polaris Motorcycle Tours Limited and all associated suppliers as a result of participant changes.
    • The transferee agrees to all original tour booking terms and conditions and all other terms of the contract between us and the original client.
    • Both the original client and the transferee assume joint liability for all outstanding costs.
    • If any service cannot be transferred within 14 days of the commencement of the tour, the cancellation charges as set out in section 7 will apply.

 

7. Cancellation of Bookings

Should the client wish to cancel a tour, the following cancellation charges will be imposed. These cancellation charges are calculated from the day that written notification (email or recorded post) is received by Polaris Motorcycle Tours Limited as a percentage of the total tour price per person cancelling. The cancellation charges shown below are those which will apply to all tours. You will be specifically advised at the time of booking if any cancellation charges differ from the following.

→ If written cancellation is provided more than 90 days before the tour start date:
• A full refund, minus 3% of any credit/debit card payments made to that point to cover credit/debit card processing fees.

→ If written cancellation is provided 89-61 days before the tour start date:
• The retention of the 20% deposit will be made without refund to cover all administration and supplier charges.

→ If written cancellation is provided 60-31 days before the tour start date:
• The retention of 50% of the tour price will be made to cover all administration and supplier charges.

→ If written cancellation is provided within 30-1 days before the tour start date:
• The retention of 100% of the tour price will be made to cover all administration and supplier charges, and the loss of the tour sale to Polaris Motorcycle Tours Limited.

 

8. Insurance for Cancellations

It is an absolute and non-negotiable condition of booking with Polaris Motorcycle Tours Limited that comprehensive travel insurance is taken out by all persons participating in a tour at the client’s sole expense (see section 11). It is also strongly recommended by Polaris Motorcycle Tours Limited that each client also takes out cover against trip cancellation charges to cover any potential eventuality. Depending on the reason for a cancellation, each client may be able to reclaim the cancellation charges (less any applicable excess) under the terms of any held trip cancellation insurance policy. Polaris Motorcycle Tours Limited will provide any honestly known and genuinely held information as requested in support of any such claim. All claims must be made direct to the insurance company, and the relevant insurance company are required to contact Polaris Motorcycle Tours Limited by emailed or written correspondence at the following email or post addresses.

9. Cancellation Due to Unavoidable & Extraordinary Circumstances

Each client retains the right to cancel any tour prior to departure without paying a cancellation charge in the event of ‘unavoidable and extraordinary circumstances’ which are occurring at the tour destination or within its immediate vicinity and which will significantly affect the performance of the tour. In these circumstances, Polaris Motorcycle Tours Limited will provide a full refund of all monies paid to each affected client, but without any form of compensation. Please note that the right to cancel under these circumstances will only apply where the U.K. Foreign & Commonwealth Office (FCO) advises against travel to the tour destination or its immediate vicinity.

For the purposes of this section, ‘unavoidable and extraordinary circumstances’ relates to:

→  Active conflict/warfare.

→  Ongoing or heightened risks of serious terrorism.

→  Serious risk to human health, including the outbreak of serious disease at the travel destination.

→  Active or the serious threat of natural disasters, such as floods, earthquakes, or significant weather conditions which make it impossible to travel safely to the travel destination.

*Please note that there is no automatic statutory right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Directive 2011/83/EU), and that each situation will be fairly considered and reviewed between Polaris Motorcycle Tours Limited and the client.

 

10. Passports, Visas, Travel Documents, Vaccinations

Clients are personally responsible for researching, arranging, and being in possession of the following applicable passport, visa/s, travel document/s, and vaccination/s for their applicable tour destination/s:

→  A valid passport with the required remaining validity period per each country requirement.

→  All valid travel Visa and reciprocal fees per each country requirement and the client’s nationality.

→  All other required travel documents per each country requirement and the client’s nationality.

→  All mandatory and recommended vaccinations and prophylaxis per each country requirement.

It is important to note that each client must research and check the requirements for their own specific circumstances with the relevant Embassies and/or Consulates (passports, Visas, travel documents) and with a medical professional (vaccinations and travel health) in good time prior to the tour start date. Polaris Motorcycle Tours Limited cannot give specific advice relative to these requirements due to the complexity of individual client requirements and due to medical confidentiality.

However, Polaris Motorcycle Tours Limited will provide specific in-country advice vrelative to tours that cross international borders, and this information will be included in the information pack.
Polaris Motorcycle Tours Limited will make all assumptions that each client has the correct passport, Visa/s, travel document/s, and vaccinations required for all aspects of the travel relative to each booked tour. Polaris Motorcycle Tours Limited cannot accept any liability if you are refused entry onto any flight or transport into any country due to failure on your part to obtain all required documentation or of a failure to comply with any immigration requirements or health formalities. The failure of travel will be classified as a cancellation as listed under section 7. If found in contravention of any official immigration or health violations during a tour, the client remains responsible for any fines or prosecution levied.

 

11. Travel and Cancellation Insurance

Comprehensive medical travel insurance is mandatorily required to be obtained by all clients while taking a tour with Polaris Motorcycle Tours Limited in any country. All persons taking a tour with Polaris Motorcycle Tours Limited do so entirely at their own risk, and therefore there is a significant requirement for having comprehensive medical travel insurance insurance in the event of an incident. Comprehensive travel medical insurance is required to be taken out by the client and shared with Polaris Motorcycle Tours Limited no more than 7 days prior to the tour start date.

Exceptions on the above requirement can be made where the tour is being taken in a participants home country, or where Polaris Motorcycle Tours is provided assurance in writing that other medical support provision is provided. 

The insurance policy for each client must be:

→  Specifically named to each client.

→  Specifically dated to cover the entire tour dates.

→  Must include all medical treatment and costs.

→  Must include medical repatriation.

→  Must include repatriation of mortal remains.

→  Must have no exclusion clauses limiting or excluding protection for the type of activities included in

the tour, including riding a motorcycle of the specified engine size as outlined in the tour description, both on and off road.

It is important to note that clients should satisfy themselves that all travel medical insurance requirements are met. Polaris Motorcycle Tours Limited will not review and cannot be held responsible for any eventuality where insurance coverage falls short or is declined due to incorrect coverage or exclusion technicalities. It is important to note that a pre-condition of booking with Polaris Motorcycle Tours Limited is that each client will provide their insurance details (insurance company name, policy number, policy coverage wording, insurance contact phone numbers) no less than 7 days before the tour start date and on request. Polaris Motorcycle Tours Limited will not allow clients to undertake motorcycle tours without an adequate travel medical insurance and repatriation policy being in-place and evidenced. Polaris Motorcycle Tours Limited will treat the failure to provide the required insurance policy details as a cancellation in alignment with the conditions laid out in section 7. All clients should understand that this requirement is in correlation to our ethical standards of providing the upmost safety and security for all clients undertaking tours with Polaris Motorcycle Tours Limited and the requirement is not negotiable or flexible. The receipt and holding of travel insurance policies allows Polaris Motorcycle Tours Limited to appropriately react and to support clients in the event of any potential incident.

 

12. Making a Complaint

Polaris Motorcycle Tours Limited will endeavor in every way to ensure that you enjoy a lifetime experience on your tour and that you receive absolute satisfaction in our service delivery. Should any client have a complaint about any of their tour arrangements, the client must tell the tour representative that is driving that specific tour at the time of the issue in order that it can immediately be addressed and resolved. Only if Polaris Motorcycle Tours Limited knows about a potential problem will there be the opportunity to proactively address it. The failure of a client to raise any issue as soon as possible may result in the client’s ability to pursue a complaint or potential compensation from Polaris Motorcycle Tours Limited after the fact. Should a client feel unable to raise an issue or complaint at the time of the occurrence, or as soon as practicable thereafter, we would invite a call, email, or posted correspondence detailing:

→  Client name, contact details, and which tour they took which was relative to the issue/complaint.

→  The exact nature and description of the issue/complaint.

→  Why the issue/complaint was not reported at the time.

→  What Polaris Motorcycle Tours Limited can do to address or to put the issue/complaint right.

 

13. Tour Participation and Client Responsibility

To ensure the optimization of safety, security, and general enjoyment during tours, clients agree to accept the authority and decisions of Polaris Motorcycle Tour Limited employees, partners, tour leaders, and agents during tours. If any such person/s related to Polaris Motorcycle Tours Limited considers that the health, level of fitness, riding ability, or general conduct of a client at any time before or during a tour is endangering or appears likely to endanger the health or wellbeing of the client or any third party (including any other clients) or the safe, comfortable, or enjoyable progress of the tour, the client may be engaged and excluded from all or part of the tour without refund or recompense. Where a client is excluded on the grounds of what are considered as any inappropriate behaviors, Polaris Motorcycle Tours Limited will have no further responsibility towards them (including not coordinating return travel arrangements) and Polaris Motorcycle Tours Limited we will not meet any expenses costs incurred as a result of the exclusion. In the case of poor/ill health, level of fitness, or riding ability, Polaris Motorcycle Tours Limited may make such arrangements as it sees fit and may potentially seek to recover the costs thereof from the client or from the client’s insurance, depending on the circumstances. If a client commits any illegal act in the country of a tour, the client may be excluded from the tour without refund or recompense. When clients book with Polaris Motorcycle Tours Limited, they accept responsibility for any damage or loss caused by them, whether accidentally or purposely. Full payment for any such damage or loss

(reasonably estimated if not precisely known) must be made directly to the supplier or to us as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, the client will be responsible for paying the additional difference. If the actual cost is less than the amount paid, the difference will be refunded. The client will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other parties’ full legal costs) as a result of any client actions. Each client should ensure that they have appropriate travel insurance to protect against such potential occurrences.

 

14. Tour Changes

While Polaris Motorcycle Tours Limited will do its best to operate all tours as advertised, we reserve the right to amend tours, services, prices, or itineraries described in the tour brochure and/or on our website at any time before or after your booking is confirmed due to any unforeseen issues. Most changes will be minor, and in any such circumstances where the change is a significant deviation from that originally advertised, we will inform you as soon as reasonably possible. There will be no cancellation rights resulting from any changes that are not significant to the primary tour dates and destinations.

Significant changes are classified as:

→  A change of departure date of tour.

→  Any major itinerary re-routing.

In the event of a significant tour change as noted above, Polaris Motorcycle Tours Limited agrees to honor full cancellation of the tour if/as requested and full reimbursement of all paid monies.

 

15. Tour Cancellation – Force Majeure or Minimum Tour Number

Polaris Motorcycle Tours Limited will not cancel any tour less than 60 days before a departure date, except for reasons of force majeure or of any client failure to pay the final balance as scheduled. We may cancel any tour before this date if the minimum number of clients required for a particular tour is not reached. If we have to make a significant change or to cancel your tour before the departure, the client will have the choice of:

→  Cancelling the tour with a full refund of all monies paid.

→  If available, accepting an offer of an alternative tour (we will refund any price difference if the alternative is of a lower value).

Polaris Motorcycle Tours Limited cannot meet any travel, Visa, vaccination, or any other costs in the event of any tour change or tour cancellation by us. You are advised to book fully flexible air and connecting transport which can be cancelled or changed without charge. Polaris Motorcycle Tours Limited will not be responsible to reimburse any cancellation, amendment, or any other charges that a client may incur in relation to any arrangements which need to be changed or cancelled as a result of any tour change.Polaris Motorcycle Tours Limited will not be liable for any compensation if our contractual obligations are affected by force Majeure. Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (or significant threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination, pandemics or epidemics including the ongoing effects of Covid-19, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or to remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned control.

 

16. Risk Acceptance Terms & Conditions

All tour bookings are accepted on the understanding that clients appreciate and accept the possible risks inherent in motorcycle adventure travel and that they undertake the tours in our program completely at their own risk, volition, and potential risk of physical harm and loss. We will also only agree to provide or to arrange services for you as an ‘organiser’ under the Package Travel and Linked Travel Arrangements Regulations 2018, and as such, we are only responsible for the proper provision of all tour services included in your tour booking, as set out in your confirmation invoice. Subject to these terms and conditions, if we or our suppliers negligently perform those services and we don’t remedy or resolve your complaint within a reasonable period of time, subsequently affected the enjoyment of your package tour, you may be entitled to an appropriate price reduction or compensation.

You must inform us without undue delay of any failure to perform or of providing improper performance of the arrangements included in any tour.
If it is considered that there has been a failure to provide or to perform as promised, the level of any such price reduction or compensation will be calculated taking into consideration all relevant factors such as but not limited to:

→  Adhering to the complaints procedure as described in section 12 of these terms and conditions.

→  A full explanation and evidence of the incident, including witnesses, as may be available.

→  A full explanation of the extent to which our or our employees’ or suppliers’ negligence affected the overall enjoyment of your tour.

Please note that it is the client’s responsibility to show that we or our supplier/s have been negligent if you wish to make a claim against us.
We will not be responsible for any injury, illness, death, or physical or possessions loss – including loss of any enjoyment, damage, expense, cost, future employment, or other sum or claim of any description whatsoever which results from any of the following:

→  The act/s and/or omission/s of the client/s.

→  The act/s and/or omission/s of any of the tour party.

→  The act/s and/or omission/s of any third party not connected with the provision of the tour and which were unforeseeable, unavoidable, or force majeure as defined in section 15.

We limit the amount of compensation that we may have to pay if we are found liable under this section, and that the maximum amount that we will have to pay in respect of these claims is an amount equivalent to the insurance policy excess which applies to this type of loss per person in total because each client is requested and required to have adequate insurance in place to cover any losses of this kind.

Polaris Motorcycle Tours cannot accept responsibility for any services which do not form part of our service provision or contract. This includes, for example, any additional services or facilities which any supplier agrees to provide for you where the services or facilities are not advertised by us, and we have not agreed to arrange them as part of our contract. Any optional excursions or activities booked during your trip do not form part of our contract as these will be arranged for you directly by the suppliers concerned. In addition, regardless of any wording used by us on our website, in any advertising material or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you. The promises that we make to you about the services we have agreed to provide or arrange as part of our contract – and the laws and regulations of the country in which your claim or complaint occurred – will be used as the basis for deciding whether the services in question had been properly provided. Please consider that standards of safety, hygiene, and quality may vary throughout the tour destinations, and that the services and transport that your tour involves may be of a lower accepted standard than or different to those in other countries. If the particular services which gave rise to the claim or complaint complied with the local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the England and Wales where Polaris Motorcycle Tours is incorporated.

Please note that we cannot accept any liability for any damage, loss, expense, or other sum(s) of any description:

→  Which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you.

→  Relates to any business.

→  Is an indirect or consequential loss of any kind.

 

17. Cessation of Tour

Where a tour is stopped for any reason as dictated by Polaris Motorcycle Tours Limited or agents acting on our behalf, if it is impossible for you to return to your departure point as per the agreed return date of your package, we will provide each client with necessary accommodation for a period not exceeding three nights per person while we manage safe extraction. For the purposes of this clause, ‘unavoidable and extraordinary circumstances’ means a tour stopped on significant safety or security grounds by Polaris Motorcycle Tours or an agent acting on behalf of us, and includes warfare, acts of terrorism, significant risks to human health such as the outbreak of serious disease at the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely back to your departure point.

 

18. Optional Excursions/Activities

On some tours, Polaris Motorcycle Tours Limited may provide you with information (before departure and/or during the tour) about optional activities and excursions which do not form part of your pre-booked tour arrangements and which are available in the area you are visiting with other third-party agents and providers. Please note that we have no involvement or liability in any such activities or excursions which are not run, supervised, or controlled in any way by us, and which are offered and provided by local operators or other providers who are entirely independent of us and that may or may not have their own public liability insurance. They do not form any part of your contract with us and cannot accept any liability on any basis in relation to such activities or excursions undertaken at the client’s discretion.

 

19. Emergency Assistance

During your tour with Polaris Motorcycle Tours Limited, if you find yourself in personal or medical difficulty for any reason, we will offer you support and assistance as appropriate under the circumstances. In particular, we will provide you with appropriate information on health services, local authorities and consular assistance, and assistance with insurance and family communications, and in finding alternative travel arrangements as may be needed. Where you require assistance which is not owing to any failure by us or our agents, we will not be liable for the costs of any alternative travel arrangements or other such assistance that you may require. Subject to our terms and conditions, we will not be liable for any costs, fees, or charges that you incur in the above circumstances, and furthermore, we reserve the right to charge you for above-and-above assistance in the event that the difficulty is caused intentionally by you or a member of your party, or otherwise through you or your party’s negligence, or as a result of a medical emergency that is not covered by your travel medical insurance policy.

The information advertised and presented by Polaris Motorcycle Tours Limited is conducted in an honest and transparent manner and is believed correct to the best of our knowledge at the time of printing or publication. However, errors may occasionally occur, and information may subsequently be changed without notice at our discretion. You must therefore ensure you check all details of your chosen tour, including the price, at the time of booking.
